My email is being used by someone else the recovery email address is not my email. How do I get around the problem?

When was the last time you signed into this account from the Yahoo website?  Yahoo deactivates accounts that haven't been signed into at least once in the last 12 months.  Once the account has been deactivated it's unlikely you can recover it.

If it's been years since you last signed into this account then what happened is Yahoo deleted your account and then recycled your email address for public use.  Someone else claimed the email address and they set their own recovery options.  In this case you're trying to recover an account that is no longer yours.

My email was hacked and password and recovery email was changed less then a year ago

When was the last time you had signed into this account to check your email?  When do you believe your account was compromised?

If you believe your account was compromised start with the article above.
 
If you had a recovery email address and/or recovery phone number listed on the Account security page of this account you would receive notification by email and by text that your password and/or recovery information was changed and what to do if you didn't make these changes.  If your account recovery information was changed Yahoo retains your old information for approximately 90 days so that you can recover your account using your previous information.
 
Start the account recovery process by going through the Sign-in Helper.   
 
Choose the option "I don't have access to this phone" or "I don't have access to this email" when you see the account recovery options that aren't yours to see what other account recovery options are available.  If you don't see the account recovery options you set then you won't be able to recover your account using the automated system.
 
If you are able to recover this account you can use the first article posted above and the next article below to secure your account and check for unusual account activity.

Your final option would be to check if you can contact a Yahoo specialist for assistance.  Please note this option is not available in all markets.
 
1. Start here at Help for Yahoo Account - https://help.yahoo.com/kb/account
2. Scroll down the page until you see a "Contact Us" button.  Click on this.
3. This opens a Yahoo Help Central Support page.
4. Under "Tell us your Yahoo email address and product." you select the product you want help with.  In this case it would be "Account".
5. Enter your email address and check "I'm not a robot".  You may be sent to another CAPTCHA page for additional proof.
6. Click the "Get started" button.
7. This opens a page that says “Select from these options”.
8. The option you are looking for is "Contact a Yahoo specialist".  Please note this option is not available for all issues and in all markets.  If you see this option click on it.
9. This opens the page “What can we help you with”.  Select the topic that most closely matches your issue.
10. Next is the page “Tell us more about this issue”.  Select the topic that most closely matches what your issue.
11. Next is the page “Here’s how to get help” which will show you the contact options available such as chat, email a Yahoo specialist, or Ask the Yahoo community.
 
If you weren’t able to recover your account all is not lost.  Yahoo will deactivate any account that has not been accessed at least once in the last 12 months.  Once the account has been deactivated it's marked for deletion and after a short wait deleted.
